Pak Servers wishes to provide its customers with quality web hosting services. To accomplish this, all customers need to follow some rules and guidelines. These policies are intended to maintain a high quality level of services and make them available to all of its customers on a fair, consistent and efficient basis.

The use of our services immediately constitutes acceptance and acknowledgement of these Terms of Service, any applicable domain name registration agreements and all policies and guidelines. Pak Servers reserves the right to modify its terms and conditions at any time and from time to time in its sole discretion and the modifications would be effective as soon as they are updated in this document. Pak Servers reserves the right to terminate or interrupt any account, in part or in full, without refund for violation of these terms. In case of any dispute, resolution will be handled on an individual basis at the sole discretion of the higher management of Pak Servers.

Account Setup / User Contact Details

We will set up your account after we have received the payment and your order has been screened for fraud. It is your responsibility to provide us with a valid and functional email address which is not at the domain(s) you are signing up under.

Any further correspondence with you would be carried out on the email address in our records and all administrative requests for your domain would be entertained only if they are through your default email address.

Website Content

Pak Servers is not obligated to monitor the network for the purpose of examining customer's content including but not limited to electronic mail transmission, mailing lists, news groups or other material created or accessible over our servers. You hereby acknowledge that if we are made aware of content that is determined to be, in the sole discretion of Pak Servers, unacceptable, undesirable, offensive, indecent, obscene, excessively violent or otherwise objectionable, Pak Servers has the right, but not the obligation, to edit, remove or deny access to such content. Pak Servers may disclose any content or records concerning customer's account as required to satisfy any legal requirement, regulation, government request or court order.

Non-acceptable content or links include but are not necessarily be limited to:

Adult Content – Any erotic or pornographic material, links to adult sites, or advertisements for adult sites.
Pirated Software (Warez) – Any software that is copyrighted and not freely available for distribution without cost; i.e. ROMs, ROM Emulators and MPEG Layer 3 files (MP3).
Copyright Violations – Violation of copyrights held by individuals and corporations or other entities can result in civil and criminal liability for the infringer.
Hacking/Phreaking – Includes sites with material, links, or resources for hacking, phreaking, viruses, anarchy, or any type of site that promotes or participates in willful harm to Internet sites or providers.
IRC Bots/Eggdrops – IRC Bots or any other automation programs used specifically in conjunction with IRC are not allowed.

SPAM / Unsolicited Emails

You or accounts under you must not use our network, equipment or any email address in connection with the transmission of spam, flames, mail bombs, or substantially similar, unsolicited email messages. When any customer is found to have been engaged in spamming, Pak Servers reserves the right to disable that customer's web site without any warning and/or cancel the services without any refund. In addition, Pak Servers may impose a PKR 2000 penalty for each spam policy violation.

Pak Servers solely reserves the right to refuse or cancel the service to spammers, at its sole discretion.

System Security

Customers may not use the Pak Servers Networks to attempt in any way to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing any data not intended for the customer, logging into any server or account the customer is not expressly uthorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization's security policy. Customers may not attempt to interfere or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. Pak Servers will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.

Information Security

Vulnerabilities in your website code can lead to information leak and compromise of data stored anywhere on your hosting account including but not limited to your website files, email accounts and databases. Although we have security systems in place that suppress most of the attacks on a website, it is your responsibility to make sure that your website code is secure. Pak Servers will not be responsible for any theft of secret information contained within your hosting account.

Account Cancellation, Money Back Guarantee, Refunds & Downgrades

Domain Registration: All domain fees are non-refundable once the domain has been registered/transferred/renewed. The registrant is totally responsible for any spelling mistakes made during the signup process. Once registered, the domain registration can not be reversed and Pak Servers will not be liable to correct the spelling mistake or refund the fees.

Web Hosting Services: Each of our shared and reseller packages carry a 15 day unconditional money back guarantee on them. If you are not completely satisfied with our services within the first 15 days of your service, you will be given a full refund. In case a free domain is given with any package, the domain fee, equal to the fee mentioned on our website, would be deducted from the refund. After 15 days no refunds are provided. In case your services are cancelled/terminated due to violation of our Terms of Service, no refund will be given even within the first 15 days. In case of hosting package downgrades, no refund is issued for any unused time of the previous package and the change in amount is applicable from the next invoice only. The following methods of payments are non-refundable, and refunds will be posted as credit to the hosting account:

99.9% Uptime Guarantee

If your shared / reseller server has a physical downtime that is not within the 99.9% limit you may receive one month of credit on your account. Approval of the credit is at the discretion of Pak Servers dependant upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor's network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please contact the Sales Department with a valid justification.

Payment Information & Late Fee

You are required to supply appropriate payment for the services received from Pak Servers, in advance of the time period during which such services are provided. It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. Pak Servers provides a 10 day grace period from the time the invoice is due and when it must be paid.

Any invoice that is overdue for 10 days and not paid will result in a PKR 200 late fee and/or an account suspension until account balance has been paid in full. For domain names, any domain(s) that are not paid within one month of registration/renewal are transferred in favor of Pak Servers. In such a case, the ownership of domain can be reclaimed by paying the ownership reclamation fee of amount up to 5 times the cost of registering a domain, which shall be decided upon by Pak Servers in its sole discretion. Pak Servers reserves the right to change their package pricing and any other charges at any time with or without any notice.

Lost Account Ownership Transfers

It is your responsibility to keep your contact information up to date especially your email address as all communication is primarily done via email. In case you lose access to the email address that is registered with Pak Servers, we will not transfer the account to your new email address without proper documentation and submission of account transfer fees. The documentation required and the fees involved will be disclosed to you depending on the extent of verification required. If the documents or fees are not submitted or the verification is not successful for some reason, Pak Servers is not obligated to restore your access to the domain name or hosting account.

Excessive Resource Usage

Each hosting account has an agreed amount of monthly bandwidth limit which varies depending on the hosting package you purchase. Bandwidth is the amount of data transmitted to and from your account (E-mail, Shell, Website, FTP). Pak Servers will make available the bandwidth utilization of each website via customer control panel. Should your account pass the allocated amount, Pak Servers reserves the right to suspend the account until the start of the next allocation or until either more bandwidth is purchased at an additional fee or you upgrade to a higher level of package.

Any web site that uses an excessively high amount of server resources including but not limited to CPU time and memory will be given an option of either upgrading their service level or reducing the resource used to an acceptable level. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

Backups & Data Loss

Your use of the service is at your sole risk. Pak Servers is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers. We provide daily, weekly and monthly backups of your hosting account which can be obtained in case of need however they are not guaranteed to be available.

Warranties/Disclaimer

Pak Servers will not be responsible for any damages your business may suffer and makes no warranties of any kind, expressed or implied for services we provide. Pak Servers disclaims any warranty or merchantability or fitness for a particular purpose including data theft or data loss resulting from any action including but not limited to delays, non-deliveries, wrong delivery, and any and all service interruptions of any kind caused by Pak Servers and its employees.

Limited Liabilities

You agree that you will protect, indemnify, save and hold Pak Servers, harmless from any and all stipulations, liabilities, losses, expenses and claims, as well as reasonable legal fees assessed against Pak Servers, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold to you, your agents, employees or assigns. You agree to defend, indemnify and hold Pak Servers, harmless against liabilities arising out of:

Any injury to person or property caused by any products sold or distributed in association with Pak Servers Services;
Any material furnished by you infringing or allegedly infringing on the proprietary rights of a third party;
Copyright violation and any defective products sold to a customer from servers owned by Pak Servers;
Leakage of confidential information due to vulnerabilities in your website code.

Privacy Policy

Any personal information received will be kept highly confidential and will only be used for our records. However, in case you use your personal information in a domain's public whois information without purchasing the ID Protection service, the general public might be able to see that information by performing a whois lookup on the domain name.
